About these Terms
Thanks for signing up to use BrowserOS. These terms (Terms) apply to:
- your access to BrowserOS;
- your use of the software that powers BrowserOS (Software);
- and any documentation that we provide to you.
In these Terms, we sometimes refer to BrowserOS and the Software together as the "Services".

Fair use of our Services
When you accept these Terms we'll grant you a licence to use our Services. This license is non-exclusive (meaning we can grant the same licence to all users of our Services) and it's personal to you only (meaning you can't transfer the licence to anyone else).
When you accept these Terms, you agree not to:
- access our Services so that you can build a product or service that competes with BrowserOS;
- commercially exploit our Services without our written permission. This includes licensing, selling, renting, or leasing parts of our Software;
- copy parts of our Software, or create new software that's based on our Software;
- access or tamper with areas of BrowserOS that aren't public, or try to get around the measures we have in place to protect these areas;
- use our Services to store or distribute any malicious software (like viruses, trojan horses, worms, or malware);
- use our Services to store any material that's unlawful, harmful, or offensive;
- or break the law when using BrowserOS.
Accounts and Membership
You must be at least 13 years of age to use the Services. By using the Services you warrant and represent that you are at least 13 years of age. We may, but have no obligation to, monitor and review new accounts before you may sign in and start using the Services. Providing false contact information of any kind may result in the termination of your account.
Making changes to BrowserOS
We'll do our best to keep you up to date when we're making changes to our Services. We can change, update, pause, or discontinue any of our product features at any time. We don't need to give you any notice beforehand, but we'll try to be reasonable and let you know when we can.
Ownership of our Services
When we say "Intellectual Property Rights", we mean any patents, copyrights, moral rights, trademarks, business names, domain names, designs, software rights, or confidential information that we hold. We also mean any other intellectual property rights (registered or not registered) that we hold now, or will hold in the future.
We and our licensors own all of the Intellectual Property Rights to our Services, and these Terms don't give you any of these rights.
Transferring rights and obligations
In the future, we might transfer the rights and obligations we have under these Terms to another company, as long as it doesn't materially affect your rights. You can't transfer your rights or obligations under these Terms to anybody else. This is because these Terms are personal to you — and nobody else is entitled to benefit from them.
Making changes to these Terms
As we grow and improve BrowserOS, from time to time, we might need to make changes to these Terms.
Sometimes, when we release a new product feature or service, we might decide to introduce new terms relating to that feature. We might provide them separately to these Terms. If we do, you'll need to agree to those terms before you can use the feature.
If you carry on using our Services after we make changes to the Terms, it means you've agreed to them. The new version of the Terms replaces the old version — so the new Terms apply going forward.
Paid services
Some parts of the Service are made available on a paid subscription basis ("Subscription(s)"). Pricing and included features for the Subscriptions ("Subscription Plan(s)") are set forth here: https://browseros.com/. "Subscription Fees" means all fees associated with your Subscription.
You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing Cycles are set on a monthly or yearly basis. Whether you are using monthly or yearly billing, your account may be charged on a monthly basis.
Auto-Renewal: You agree that at the end of each Billing Cycle, your Subscription will automatically renew and your payment method for such Subscription will automatically be charged at the start of each new Subscription period for the fees and taxes applicable to that Billing Cycle, under the same conditions as the prior Billing Cycle unless you cancel your Subscription prior to your renewal date.
A valid payment method, including credit card, is required to process the payment for your Subscription. You must provide BrowserOS with accurate and complete billing information including full name, address, state, zip code, and valid payment method information. By submitting such payment information, you automatically authorize BrowserOS to charge all Subscription Fees incurred through your account to any such payment instruments.
Should automatic billing fail to occur for any reason, BrowserOS may attempt to charge the credit card on file one or more times. Should payment continue to fail, the Subscription will be, at BrowserOS's sole discretion, canceled or downgraded and you may lose access to certain paid features and/or your Workspace and BrowserOS account.
You may cancel your Subscription either through your online account management page or by contacting BrowserOS team at founders@felafax.ai and indicating your intention to cancel your Subscription.
AI Feature and Privacy
BrowserOS offers an AI feature, AI chat and agent, which leverages OpenAI's ChatGPT technology to enrich your browsing experience. Chat and Agent are activated on user request, interacts with the plain text visible on your current webpage. No cookies, extensions, preferences, or passwords are ever transmitted. However, if personal data is visible in plain text and Agent is engaged, it may be included in the context sent to OpenAI. Please exercise discretion when using this feature.
Data sent to the OpenAI API is anonymized and can't be traced back to individual users, as it's chunked together and sent from BrowserOS without any direct link to your user account or ID. Data retention complies with OpenAI's standard policies, which you can review in OpenAI's privacy policy.
Using AI chat and agent is entirely voluntary. Data will only be transmitted to OpenAI if you actively engage the feature. By using AI chat and agent, you agree to these terms and our Privacy Policy.
Fees and Fee Changes
BrowserOS, in its sole discretion and at any time, may modify the Subscription Fees for the Subscriptions. Any Subscription Fee change will become effective at the end of the then-current Billing Cycle.
BrowserOS will provide you with reasonable prior notice of any change in Subscription Fees. Your continued use of the Service constitutes your agreement to pay the modified Subscription Fees.
Subscription Fees are stated exclusive of any taxes or similar governmental assessments of any nature, including, for example, value-added, sales, use or withholding taxes, assessable by any jurisdiction (collectively, "Taxes"). You will be responsible for paying all Taxes associated with your Subscription, except for those taxes based on our net income. Should any payment for the Service be subject to withholding tax by any government, you will reimburse us for such withholding tax.
Free Trial
BrowserOS may, at its sole discretion, offer a Subscription with a free trial for a limited period of time ("Free Trial"). If you are on a Free Trial, you may cancel at any time until the last day of your Free Trial by following the cancellation procedures outlined in the Subscription section of these Terms. If you or BrowserOS cancel your Free Trial, you acknowledge and agree that we may delete all of your User Content or data associated with the Workspaces that was assigned to your Free Trial. If you do not cancel your Free Trial, then your Free Trial will be converted to a paid Subscription at the end of the trial period, and you hereby authorize us to charge your credit card or other payment method for continued use of the paid Service under such Subscription.
At any time and without notice, BrowserOS reserves the right to (a) modify the terms and conditions of any Free Trial offer; (b) cancel any Free Trial offer; or (c) cancel any Free Trial subscription at any time.
Refunds
14-day money-back guarantee: if you decide you no longer wish to use or retain access to the services to which you've subscribed and paid for, you may contact us via emailing founders@felafax.ai to request cancellation within 30 days of the original purchase to receive a refund. This only applies to first-time purchases for new users.
All other payment obligations are non-cancelable, and fees paid are non-refundable and there are no credits for partially used Subscription periods.
Ending or limiting our Services to you
If you don't follow the Terms we've set out, we can remove your access to BrowserOS straight away. This means that you'll no longer be able to access your account, and you won't be allowed to open a new account in the future.
We can also remove your access to all or parts of BrowserOS without giving you a reason. If we want to do this, we'll provide you with at least 30 days' notice. From time to time, we might need or choose to impose limits on our Services. If we do, we'll try to give you 30 days' notice.
Our responsibilities
While we hope you'll love using BrowserOS, we can't guarantee that it'll meet your needs. We also don't guarantee that the service will always be available, or be free from errors. From time to time, it's possible that your access to the service will be interrupted. If this happens, we won't be responsible for any loss or damage that comes about as a result.
We take steps to preserve your data, and protect its integrity. We won't be responsible for loss of your data, or any corruption to it.

How we enforce these Terms
To keep BrowserOS safe and running smoothly, we keep an eye on how people are using our Services, and take action when we need to. You agree that we can monitor your use of BrowserOS to make sure you're not breaking our Terms. We'll always do this in line with our privacy policy.

What laws apply to these Terms?
These Terms are governed by California law and the courts of California will have jurisdiction over any claim. If you're a resident outside of the United States, then you'll continue to have all of the consumer rights available to you in your country of residence.
